What are the legal requirements for first aid at work?

The Health and Safety (First-Aid) Regulations 1981 require employers to provide adequate and appropriate equipment, facilities and personnel to ensure their employees receive immediate attention if they are injured or taken ill at work.

These Regulations apply to all workplaces including those with less than five employees and to the self-employed.

What is ‘adequate and appropriate’ will depend on the circumstances in the workplace. This includes whether trained first-aiders are needed, what should be included in a first-aid box and if a first-aid room is required. Employers should carry out an assessment of first-aid needs to determine what to provide.

How do I assess first-aid needs?

Employers are required to carry out an assessment of first-aid needs. This involves consideration of workplace hazards and risks, the size of the organisation and other relevant factors, to determine what first-aid equipment, facilities and personnel should be provided.

What is an appointed person?

Where your assessment of first-aid needs identifies that a trained first-aider is not required in your workplace, you should appoint someone to take charge of first-aid arrangements. This is the minimum requirement.

Even in a small, low-hazard business where first-aiders are not considered necessary, there is always the possibility that an accident or sudden illness may occur. It is therefore important that there is always someone available to take charge of these arrangements.

The role of this appointed person includes looking after first-aid equipment and facilities and calling the emergency services when required. They can also provide emergency cover where a first-aider is absent due to unforeseen circumstances (annual leave does not count). An appointed person does not need first-aid training.

An appointed person is not necessary where there are an adequate number of appropriately trained first-aiders.

What is a first-aider?

A first-aider is someone who has done training appropriate to the level identified in the needs assessment. This may be first aid at work, emergency first aid at work or some other first-aid training appropriate to the particular circumstances of your workplace.

How often do I need to update my first aid qualification?

A First Aid at Work certificate must be renewed every three years by undertaking a two day re-qualification course. You can attend a refresher course up to three months before the expiry date of your certificate. If your certificate does expire you have 28 days after expiry to take the course. If your certificate is more than 28 days out of date you will need to complete a three day First Aid at Work course again First aiders who hold a valid First Aid at Work certificate are also strongly advised by the Health and Safety Executive (HSE) to undertake annual skills update training to maintain basic skills and to keep up to date with any changes.
